Welcome to MyChairAi, a product of Best Partner Media LLC. By creating an account, accessing, or using MyChairAi, you agree to these Terms of Service. If you do not agree with these Terms, you may not use the platform.

1. Acceptance of Terms

By registering for, accessing, or using MyChairAi, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. User Responsibilities

  • You must provide accurate and complete information when creating and maintaining your account.
  • You are responsible for safeguarding access to your phone number, login credentials, devices, and account.
  • You are responsible for the accuracy of your business information, professional profiles, services, pricing, availability, portfolio images, booking links, and customer instructions.
  • You agree to use MyChairAi only in compliance with applicable laws and these Terms.
  • You agree not to misuse the platform or engage in fraudulent, deceptive, harmful, abusive, or unauthorized activities.

3. AI Receptionist Services

MyChairAi provides cloud-hosted AI receptionist services that may answer incoming phone calls, communicate with customers, provide business information, collect customer requests, discuss available services, assist with appointment scheduling, summarize conversations, and send SMS follow-up messages.

AI-generated responses may occasionally be incomplete, inaccurate, delayed, or unavailable. You remain solely responsible for reviewing customer requests, confirming appointments, verifying pricing and availability, correcting inaccurate information, and managing your customer and business relationships.

MyChairAi does not guarantee that every call, message, appointment request, booking, or customer inquiry will be completed successfully.

4. Business Services and Customer Transactions

The services displayed or managed through MyChairAi are services offered by you or your business to your own customers. These may include appointments, consultations, professional services, personal services, home services, creative services, or other real-world business services.

These business services are not digital goods, digital content, or products sold by MyChairAi. MyChairAi provides tools that help you describe, manage, communicate about, and schedule those services.

You are solely responsible for the fulfillment, quality, pricing, availability, cancellation policies, refunds, safety, legality, and customer satisfaction associated with the services your business offers.

Unless expressly stated otherwise, MyChairAi is not a party to transactions between you and your customers and does not provide the underlying service being booked or requested.

5. Phone and SMS Communications

By using MyChairAi, you authorize the platform to receive and place phone calls, send SMS messages, and communicate with customers on your behalf using AI, telecommunications providers, or automated systems where applicable.

Standard carrier messaging, calling, and data rates may apply. You are responsible for complying with all applicable communication, consent, privacy, telemarketing, and marketing laws.

You are responsible for obtaining any permissions or consents required for communications sent on behalf of your business.

6. Public Business Pages

MyChairAi may publish public pages for businesses or professionals that display information you choose to make available, including your name, images, portfolio, services, descriptions, hours, contact information, booking information, and other profile details.

Public pages may be accessible to the general public, shared by link, displayed on custom subdomains, and indexed by search engines.

You represent that you have the right to publish all information, branding, photographs, and other content submitted to your public page.

7. Cloud Service Access and Service Fees

MyChairAi includes a companion application and web-based management tools that allow users to create and manage business profiles, services, customer requests, call records, receptionist settings, integrations, and related business information.

Certain cloud-hosted services may require an active service agreement. These services may include the operation of an AI receptionist phone number, cloud telephony, AI call processing, SMS delivery, appointment scheduling integrations, and related hosted infrastructure.

Any applicable service fees relate to the operation and continued availability of those cloud-hosted services. They do not represent the purchase of digital content, media, virtual goods, or additional content within the companion application.

Creating a MyChairAi account or configuring a business profile does not by itself guarantee that all cloud-hosted services are active. The status and availability of hosted services may depend on account configuration, service eligibility, technical availability, and the applicable service agreement.

Where service fees apply, pricing, setup terms, renewal terms, cancellation procedures, and other billing conditions will be presented through the applicable service agreement or authorized billing process.

Unless otherwise stated in the applicable service agreement, recurring cloud service fees may renew automatically until canceled according to the cancellation procedures provided through the applicable billing platform.

8. Third-Party Business Integrations

MyChairAi may integrate with third-party providers that support business operations, scheduling, telecommunications, messaging, appointment management, analytics, mapping, identity, hosting, or other platform functionality.

These providers may include Square, Twilio, Apple, Google, and similar service providers.

The Square integration is used to connect a business's existing Square account and may synchronize business locations, team members, service catalogs, appointment availability, and bookings for real-world services. Connecting Square is not a method of purchasing MyChairAi or purchasing digital content from MyChairAi.

Your use of a third-party service may also be subject to that provider's own terms, policies, fees, account requirements, service limitations, and privacy practices.

MyChairAi is not responsible for the availability, accuracy, security, performance, suspension, or discontinuation of third-party services.

9. Account Access and Availability

We may require phone verification, identity verification, account authentication, or other security procedures before granting access to certain functions.

We may modify, suspend, restrict, or discontinue parts of MyChairAi at any time for maintenance, security, legal compliance, technical reasons, abuse prevention, or business reasons.

We do not guarantee uninterrupted or error-free access to the platform, telecommunications services, AI services, integrations, or public pages.

10. Intellectual Property

All MyChairAi software, branding, trademarks, logos, graphics, text, designs, interfaces, systems, and related materials are the property of Best Partner Media LLC or its licensors and may not be copied, reproduced, modified, distributed, or used without permission.

You retain ownership of the business information, images, descriptions, and other content you submit to MyChairAi.

By submitting content, you grant Best Partner Media LLC a limited, non-exclusive license to host, process, display, reproduce, and transmit that content as necessary to operate, maintain, promote, secure, and improve MyChairAi and provide the services you request.

11. Acceptable Use and Content Standards

You agree not to upload, publish, transmit, or distribute content that:

  • Is unlawful, fraudulent, defamatory, deceptive, or materially misleading;
  • Infringes another person's intellectual property, publicity, privacy, or other rights;
  • Contains threats, harassment, hate speech, or promotes violence;
  • Contains sexually explicit material involving minors or exploits vulnerable individuals;
  • Promotes illegal activity or prohibited goods or services;
  • Contains malware, phishing attempts, spam, unauthorized automation, or other malicious content;
  • Attempts to interfere with, reverse engineer, compromise, or gain unauthorized access to MyChairAi or its providers.

MyChairAi maintains a zero-tolerance policy toward abusive, unlawful, or objectionable content. We may remove, restrict, or disable access to business profiles, professional pages, portfolio images, logos, public pages, services, communications, or other content that we reasonably believe violates these Terms, infringes the rights of others, is unlawful, or is otherwise harmful.

We reserve the right to suspend or terminate accounts that violate these Terms, create risk for customers or third parties, misuse the platform, or interfere with the operation of MyChairAi.

12. Privacy and Data Processing

Our collection, use, storage, and disclosure of personal information are described in our Privacy Policy.

By using MyChairAi, you acknowledge that customer calls, transcripts, phone numbers, messages, appointment requests, and related business data may be processed by MyChairAi and its service providers as necessary to provide the platform.

You are responsible for providing any notices and obtaining any consents required for your business's collection and use of customer information.

13. Disclaimer of Warranties

MyChairAi is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Best Partner Media LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, security, non-infringement, and uninterrupted operation.

We do not warrant that AI-generated responses, summaries, transcripts, recommendations, scheduling results, imported data, or third-party integrations will always be accurate, complete, or available.

14. Limitation of Liability

To the fullest extent permitted by law, Best Partner Media LLC shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your use of MyChairAi.

This includes damages arising from missed appointments, incorrect bookings, customer disputes, inaccurate AI responses, failed calls, undelivered messages, service interruptions, third-party integrations, loss of profits, loss of business opportunities, reputational harm, or loss of data.

15. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Best Partner Media LLC and its members, officers, employees, contractors, affiliates, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from:

  • Your use or misuse of MyChairAi;
  • Your business services or dealings with customers;
  • Content or information you submit to the platform;
  • Your violation of these Terms or applicable law;
  • Your infringement of another person's rights.

16. Termination

You may stop using MyChairAi at any time.

We may suspend or terminate your account or access to some or all platform services if you violate these Terms, fail to meet applicable service obligations, create legal or security risk, misuse the platform, or if continued service is no longer reasonably practical.

Provisions that by their nature should survive termination will remain effective, including provisions concerning intellectual property, disclaimers, limitations of liability, indemnification, and governing law.

17. Modifications

We may revise these Terms from time to time. Updated Terms become effective when posted or on the effective date stated in the revised Terms.

Continued use of MyChairAi after updated Terms become effective constitutes acceptance of the revised Terms.

18. Governing Law

These Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-law principles.
